I have a fresh install of OMV and when idling the CPU is flickering between 76% and 100% i have fully updated it and installed the backports kernel, and nothing seems to get the cpu usage down.
any help please!!

If it's a process which is running amuck "top" should show the culprit.
If that doesn't show any obvious culprit can you post the output of "vmstat 2 10" here?

So something is making your CPU wait. Can you show the output of "iostat -x 2 5". The command will generate a lot of lines and you should disregard the 1st report.

it turns out that when i switched off the SMTP service cpu has dropped down to below 10% usage now.... strange

It's not strange, judging from your screenshot postfix is going haywire and causing your cpu to have to wait all the time.
Only thing I can think of is looking at postfix's logs. Those are located at "/var/log/mail.log" (ie "tail /var/log/mail.log").
